To inform you about the relevant questions regarding whether full-time teachers in public senior secondary and below schools who hold a counseling psychologist certificate can engage in counseling psychologist work and apply for a practice registration during their off-duty hours.

Explanation:
1. In accordance with the Ministry of Education's letter No. 1120122258, dated January 5, 113 (2024).

2. According to Article 5, Paragraph 1, Subparagraph 1 of the "Principles for Handling Part-time Employment of Full-time Teachers in Public Schools at All Levels" (hereinafter referred to as the "Principles"), teachers are not allowed to concurrently hold positions as lawyers, accountants, architects, engineers, or other professions subject to professional legal regulations. However, this does not apply to engaging in related matters in accordance with the respective professional regulations during off-duty hours for social welfare activities or participation.

3. Regarding the questions about Article 5, Paragraph 1 of the Principles, the explanation is as follows:
(1) According to Article 15, Paragraph 1, Subparagraph 1 of the Principles, teachers may engage in social welfare activities or other non-regular, non-continuous work during off-duty hours. The legislative intent is to consider that teachers engaging in social welfare activities during off-duty hours, provided that it does not adversely affect their primary job, academic reputation, and dignity, and is not incompatible with their primary job, is within the scope of permissible activities. Therefore, it is added as a permissible act and is not subject to the restrictions of the Principles regarding the scope of part-time employment, hours, fees, number of positions, and the requirement for approval from the employing school. Thus, when public school teachers engage in or participate in social welfare activities during off-duty hours and handle related matters in accordance with the respective professional regulations, as stipulated in the proviso of Article 5, Paragraph 1, Subparagraph 1 of the Principles, it also falls within the scope of Article 15 of the Principles. Such activities may be handled with reference to the legislative intent of the said provision, provided that they comply with the respective professional regulations. Furthermore, such activities are not permitted if they fall under any of the circumstances specified in Article 11, Paragraph 1 of the Principles.
(2) As for the "social welfare activities" referred to in the Principles, consideration may be given to whether the content of the activities is aimed at promoting public interest, whether it benefits the welfare of the general public, whether the benefits are public in nature, and whether the beneficiaries are specific, and a comprehensive judgment may be made based on general social norms.
(3) Furthermore, whether full-time teachers with a counseling psychologist license can engage in counseling psychologist work and apply for a practice registration during off-duty hours shall still be determined by the employing school based on the facts of each case and in accordance with Article 5, Paragraph 1, Subparagraph 1 of the Principles.

4. The Ministry of Education's letter No. 1000042156B, dated April 1, 100 (2011), regarding the prohibition of practice registration for full-time teachers (including counseling teachers) in public schools who hold a counseling psychologist license, and the parts that are inconsistent with the Ministry of Education's letter No. 1010213931, dated December 24, 101 (2012), and Article 5, Paragraph 1, Subparagraph 1 of the Principles, shall cease to apply from the date of this notice.
