Inform you about the Ministry of Education's interpretation of doubts regarding the calculation of Article 3, Paragraph 1 of the Regulations on Performance Evaluation of Teachers in Public Senior Secondary and Below Schools.

To inform you about the Ministry of Education's interpretation of the regulations regarding the calculation of performance evaluations for teachers in public senior high schools and below (hereinafter referred to as the "Evaluation Regulations"), Article 3, Paragraph 1.

Explanation:
1. In accordance with the Ministry of Education's letter No. Tai Jiao Guo Zi No. 1100120987, dated October 1, 2021.
2. Attached is a copy of the original letter.

3. Article 3, Paragraph 1 of the Evaluation Regulations stipulates that teachers who have served until the end of the academic year and have completed one full academic year shall undergo an annual performance evaluation.
If the service is less than one academic year but has been continuous for at least 6 months, or if the teacher has taken a leave of absence for child-rearing of children under 3 years old and has accumulated a total of at least 6 months of service,
a separate performance evaluation shall be conducted.
Regarding the legislative intent, according to Article 4, Paragraph 1, Subparagraph 3 of the Regulations for Teachers' Leave of Absence, teachers raising children under 3 years old are entitled to apply for leave of absence for child-rearing, and the school, institution, or competent authority shall not refuse the application.
The period of leave for child-rearing should generally be based on semesters.

Considering the declining birthrate as a national crisis, the performance evaluation for child-rearing leave should be treated differently from situations where other years of service are interrupted due to unforeseen circumstances.
Therefore, Article 3, Paragraph 1 was amended to specify that the separate performance evaluation does not necessarily require continuous service.
4. In summary, the accumulated service of at least 6 months mentioned in Article 3, Paragraph 1 of the Evaluation Regulations is calculated by combining the actual months of service.
If there are any remaining days in any month that do not constitute a full month, these days shall be combined and calculated as 30 days to one month.
Any remaining days less than 30 shall be counted as one month.
5. In conclusion, the accumulated service of at least 6 months mentioned in Article 3, Paragraph 1 of the Evaluation Regulations is calculated by combining the actual months of service.

If there are any remaining days in any month that do not constitute a full month, these days shall be combined and calculated as 30 days to one month.
Any remaining days less than 30 shall be counted as one month.
6. In summary, the accumulated service of at least 6 months mentioned in Article 3, Paragraph 1 of the Evaluation Regulations is calculated by combining the actual months of service.
