For your information, regarding the matter of calculating and stipulating the seniority of public elementary school teachers who previously served as full-time private school teachers.
Details:
1. In accordance with the Ministry of Education's letter No. 1130088988 dated August 9, 113 (Republic of China calendar).
2. According to Article 11, Paragraph 2 of the Teachers' Salary Act (hereinafter referred to as the "Salary Act"): "When a private school teacher transfers to a public school teacher, their salary level shall be stipulated according to the following provisions: 1. For K-12 teachers, their starting salary shall be based on their initial teaching qualifications according to Article 8, Paragraph 1, Item 1, and their salary level shall be adjusted according to Article 9, Paragraphs 1, 3, and 4; if they have obtained higher academic qualifications, their salary shall be adjusted according to the preceding article. ..." Furthermore, according to Article 10 of the same Act, salary adjustments due to higher academic qualifications shall be limited by the highest base salary of the appointed position level.
3. It is understood from the Ministry of Education's letter No. 1120124764 dated January 31, 113 (Republic of China calendar) that the legislative intent of Article 11, Paragraph 2, Item 1 of the Salary Act was to address the unreasonable situation where a private school teacher transferring to a public school might receive a lower salary in the public school than they did in the private school, based on regulations prior to the enforcement of the Salary Act. Therefore, this provision was enacted to ensure that the salary stipulated in the public school is consistent with the salary stipulated in the original private school. It does not restrict the order of precedence for calculating seniority for salary adjustment and salary adjustment based on higher academic qualifications when stipulating salary levels according to this item. The order in which prior service seniority is calculated for salary adjustment and salary adjustment for higher academic qualifications is mentioned in this item because not all private school teachers transferring to public schools have obtained higher academic qualifications.
4. In summary, when a private school teacher transfers to a public school and has obtained higher academic qualifications, and their salary level stipulated according to Article 11, Paragraph 2, Item 1 of the Salary Act is lower than their last stipulated salary level in the private school due to the limitation of the highest base salary of the appointed position level, they may first have their salary adjusted based on their higher academic qualifications, and then calculate their prior service seniority according to Article 9 of the same Act.
