Regarding the Ministry of Personnel's notification on the interpretation of "having household registration" as referred to in the "Statutes Governing Relations Between the People of the Taiwan Area and the Mainland Area," which means holding a Chinese Communist settlement permit or resident identity card.
Explanation:
1. In accordance with the Taoyuan City Government's Personnel Office's submission to the Ministry of Personnel's letter No. 1145817851 dated May 2, 114, forwarding the letter No. 1149903956 dated April 22, 114, from the Mainland Affairs Council (hereinafter referred to as MAC), and attaching one copy of the incoming letter and its attachments.
2. It is understood that Articles 26 of the "Statutes Governing Relations Between the People of the Taiwan Area and the Mainland Area" (hereinafter referred to as the Cross-Strait Regulations) and Articles 70, Paragraph 3, and 72 of the "Act Governing Retirement, Separation, and Compensation for Civil Servants" (hereinafter referred to as the Retirement and Compensation Act) stipulate that retired civil servants who receive monthly retirement pensions (including concurrent positions) and reside in the mainland area for a long period shall apply to the competent authority to change their retirement benefits to a lump-sum payment. If they do not apply for a lump-sum payment and have "household registration" in the mainland area or hold a mainland Chinese passport, their monthly retirement pensions and preferential savings interest, as well as the survivors' annual pensions and monthly compensation, shall be suspended.
3. According to the aforementioned MAC letter dated April 22, 114, attached to the case, it is stated that "having household registration" in the mainland area as referred to in Article 9-1 of the Cross-Strait Regulations, according to the MAC's letter No. 1140400280 dated March 26, 114, shall include holding a settlement permit or resident identity card issued by the Chinese Communists. Furthermore, "having household registration" as referred to in Article 26, Paragraph 3 of the same statute shall be interpreted in the same way as Article 9-1 mentioned above, both including holding a settlement permit or resident identity card issued by the Chinese Communists. In accordance with the interpretation of Judicial Yuan Interpretation No. 287, the above provisions shall take effect retroactively from the date of enforcement of Article 9-1 of the Cross-Strait Regulations (effective March 1, 93).
4. To avoid retired personnel falling under the circumstances where regular payments should be suspended as stipulated in the aforementioned regulations, retired personnel are requested to proactively report if they have the aforementioned circumstances. If there are any overpayments of regular benefits, they shall be recovered in accordance with Article 70 of the Retirement and Compensation Act and Article 16 of the "Verification of Regular Retirement and Compensation for Civil Servants."
